Massachusetts Court Rules that PFML Doesn’t Require Benefits Accrual During Leave

Effective Date: September 13, 2024

The Massachusetts Supreme Judicial Court recently ruled that the Paid Family and Medical Leave (PFML) law does not require employers to continue employees’ length of service credit, vacation, or sick leave benefit accruals during PFML.

Of course, employers can be more generous than the law requires and allow employees to continue accruing these benefits during PFML if they choose.

The Massachusetts Supreme Judicial Court’s decision in Bodge v. Commonwealth of Massachusetts was issued on September 13, 2024.
