Effective Date: September 26, 2024
The state’s employment discrimination law, which applies to employers with four or more employees in the state, now includes housing status as a protected characteristic. Housing status means a person or family’s overnight residence, regardless of permanence or habitability.
Employers should add housing status to their Equal Employment Opportunity (EEO) policies at their earliest convenience and ensure that employment decisions are not being made on this basis.
DE H 440 was enacted and effective on September 26, 2024.
